The following privacy policy (“Privacy Policy”) describes how McCurdy Laud, LLC (“the Firm”) uses and disseminates information you provide through www.mccurdylaud.com and its sub-domains and affiliated sites, as well as McCurdy Laud, LLC pages and accounts, if any, on Twitter®, Facebook®, LinkedIn®, Google Plus®, Instagram® and YouTube® (the “Sites). If you ever have questions about this Privacy Policy, please contact the Firm at the information below. Please also review the Firm’s full Terms & Conditions, which also govern your use of the Sites. By using the Sites, you are consenting to this Privacy Policy.

Collection of Your Personal Information

The Sites collect personal data to power the Firm’s Sites’ analytics, including, information about your browser, network, and device, web pages you visited prior to coming to the Sites, and your IP address. This information may also include details about your use of the Sites, including clicks, internal links, pages visited, scrolling, searches, and timestamps.

Most of the Sites do not require any form of registration with the Firm, allowing you to visit the Sites without telling the Firm who you are. However, some services, such as email opt-ins, may require you to provide the Firm with personal data. When you submit information via webform on www.mccurdylaud.com, the Firm collects the data requested in the webform in order to track and respond to your submission. The Firm shares this information with Squarespace, so that Squarespace can provide website services to the Firm. The Firm also shares this information with Clio, the Firm’s customer management system, for storage and with Google, the Firm’s email provider.

When you schedule an appointment by using the Firm’s online appointment booker, the Firm collects personal information from you to complete the booking. The Firm may collect information such as your name, email address, phone number, and details relating to your appointment (for example, the name of an adverse party). The Firm shares this information with Squarespace, the Firm’s scheduling service provider, so that Squarespace can provide online booking services to the Firm.

You may choose to proceed without providing any personal data requested by the Firm, but it may not be possible for you to gain access to certain parts of the Sites or content.

International Privacy Laws and Your Rights Under The GDPR

If you are visiting the Sites from outside the United States, please be aware that you are sending information to the United States where the Firm’s servers are located. Information you submit may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by the Firm. These countries (including the United States) may not necessarily have data protection laws as comprehensive protective as your country of residence; however, the Firm’s collection, storage, and use of your data will at all times continue to be governed by this Privacy Policy.

If you are a member of the European Union, you have special rights under the General Data Protection Regulation (“GDPR”). Those rights include that you have the right to object to the processing of your data and the right to portability of your data. All complaints must be sent to info@mccurdylaud.com. You also have the right to erasure, rectification, access, or to seek restrictions to the processing of your personal data in the Firm’s system. To the extent you provide consent to the Firm’s processing of your personal data, you have the right to withdraw that consent at any time. Any withdrawal of consent does not apply to data collected lawfully prior to such consent. You have the right to lodge a complaint with a supervisory authority containing jurisdiction over GDPR related issues.

Cookies: What They Are, And Why They Are Needed

The www.mccurdylaud.com site uses cookies and similar technologies, which are small files or pieces of text that download to a device when a visitor accesses a website or app. Cookies may be stored within your system. These functional and required cookies are always used, which allow Squarespace to securely serve the www.mccurdylaud.com site to you. These analytics and performance cookies are used on the www.mccurdylaud.com site when you acknowledge the cookie banner. The www.mccurdylaud.com site uses analytics and performance cookies to view site traffic, activity, and other data. The Firm may use cookies to personalize your visit to the Firm’s Sites as tracking usage allows the Firm to best determine the needs of the Sites’ visitors.

The Firm’s Policy With Minors

The Firm’s Sites are not intended for individuals under the age of 16. If you are under 16, you may only use the Sites under the supervision of a parent or guardian. The Firm does not collect or maintain information from anyone known to be under the age of 16, and no part of the Sites is designed to attract anyone under the age of 16. The Firm does not sell products or services intended for purchase by children. If the Firm discovers or is otherwise notified that the Firm has received any such information from a child in violation of this policy, the Firm will delete that information.

Data Retention

The Firm retains personal data collected from you for the limited period of time the Firm needs it to fulfill the purposes for which the Firm has been hired, unless otherwise required by law, or for accounting or reporting requirements. The Firm will retain and use information as necessary to comply with the Firm’s legal obligations, resolve disputes, and enforce the Firm’s agreements.

Use of Your Personal Information

In addition to any uses described above, the Firm shares personal information collected from you when visiting the Sites with Squarespace, to learn about site traffic and activity. Squarespace needs the data to run the www.mccurdylaud.com site, and to protect and improve its platform and services. Squarespace analyzes the data in a de-personalized form. The Firm also utilizes personal information collected from you when visiting the Sites to monitor and improve services and to ensure that your use of the Sites is in compliance with the Firm’s Terms & Conditions.

The Sites may serve font files from, and render fonts using, Google Fonts and Adobe Fonts. To properly display the Sites to you, these third parties may receive personal information about you, including information about your browser, network, or device, information about the Sites and the page you’re viewing, and your IP address.

You may at times receive communications from the Firm related to products and services that the Firm believes might interest you. While the Firm believes these services may enhance your time spent at the Sites, you will at all times have the option and ability to opt out from receiving these communications by specifically choosing to do so via a link which will be provided within emails that the Firm sends to you. The Firm may disclose total aggregated user statistics in order to describe the Firm’s services to relevant third parties, affiliate companies, and for other lawful purposes.

You have the right to request access to the information the Firm has for you. You can do this by contacting the Firm at info@mccurdylaud.com. The Firm will make sure to provide you with a copy of the data the Firm processes about you, and in order to comply with your request, the Firm may ask you to verify your identity. The Firm will fulfill your request by sending your copy electronically unless the request specifies a different method. If you believe that the information the Firm has about it is incorrect, or if you wish to remove your private information (such as an email address provided in an opt-in), you may contact the Firm at info@mccurdylaud.com. Any data that is no longer needed for the purposes specified herein will be deleted.

The Firm does not give away, sell, rent or lease any users’ personally identifiable information to any merchant, advertiser or web publisher. The Firm reserves the right to disclose personal information when needed to comply with the law or a legal process, cooperate with investigations of purported unlawful activities, to identify persons violating the law, or to enforce the Firm’s Terms & Conditions.

Please keep in mind that if you disclose personally identifiable information in a public manner through the Sites, this information may be collected and used by others accessing those portions of the Sites. The Firm does not monitor information you disclose on the Sites nor does the Firm accept any liability associated with your voluntary disclosure of the same.

You are responsible for reviewing the privacy statements and policies of other websites you choose to link to or from the Sites, so that you may understand how those sites collect, use and store your information. The Firm is not responsible for the privacy statements, policies or content of any other websites. Websites containing co-branding (referencing the Firm’s name and a third party’s name) contain content delivered by the third party and not the Firm.

Notice of Privacy Rights to California Residents

California law requires that the Firm provides you with a summary of your privacy rights under the California Online Privacy Protection Act (the “Act”) and the California Business and Professions Code. As required by the Act, you have the right to know whether your personal information is being collected; the right to request the specific categories of information a business collects upon verifiable request; the right to know what personal information is being collected about you; the right to say “no” to the sale of personal information; the right to delete your personal information; the right to equal service and price, even if you exercise your privacy rights. The Firm will provide you with the categories of personally identifiable information that the Firm collects through the Sites and the categories of third-party persons or entities with whom such personally identifiable information may be shared for direct marketing purposes at your request. California law requires the Firm to inform you, at your request, the categories of personally identifiable information the Firm collects and what third parties the Firm shares that information with; the names and addresses of those third parties; and examples of the products marketed by those companies. The Act further requires the Firm to allow you to control who the Firm can and cannot share that information with. To obtain this information, please send a request by email or standard mail to the address found below. When contacting the Firm, please indicate your name, address, email address, and what personally identifiable information you do not want the Firm to share with third parties. Please allow thirty (30) days for a response. Also, please note that there is no charge for controlling the sharing of your personally identifiable information or requesting this notice.

Limitations

By using the Sites you agree that the Firm is not responsible for any disclosure of your personal information made by you to a third party through your use of the Sites; any disclosure of your personal information obtained illegally from the Firm; or any accidental disclosure of your personal information made by the Firm.

Policy Changes

The Firm may modify this Privacy Policy from time to time. Any modifications will be effective immediately when the Firm posts them. When the Firm updates the Firm’s Policy, the Firm will note the date of revisions at the top of the Policy. Your continued use of a Site following any changes means you accept and agree to any changes. For your convenience and future reference, the date of the Privacy Policy is included so that you can compare any different versions of the Privacy Policy to determine any changes made to the Privacy Policy.
